Residence Permit for Other Purposes

ELIGIBILITY

 

A residence permit for other purposes may be issued to a third-country national who plans to stay in the territory of Hungary for a reason other than those specified in Sections 19–27 of the Act on the Admission and Right of Residence of Third-Country Nationals, and fulfils the requirements for the right of residence in Hungary in other respects (e.g. plans to attend a higher education institution that has not been accredited in Hungary, or for the purpose of language learning, etc.).

INFORMATION ON SUBMITTING APPLICATIONS AND THE RELATED PROCESS

Requirements: the completed form, facial photograph made not more than 3 months previously, and the prescribed enclosures, payment of the procedural fee.

 

If the applicant is a minor of limited capacity or if incompetent, the application may be submitted by the applicant’s legal representative in his/her stead.

 

When the application is submitted, the applicant’s facial likeness and – over the age of six years – fingerprint will be taken for the residence permit issued with biometric data. The third-country national affected is obliged to abide by, and perforce tolerate, that procedure.

 

Except as provided for by law, an application for residence permit may be submitted to any consulate officer of Hungary, or at any other place authorised to accept applications for residence permit located in the country where the applicant’s permanent or temporary residence is located, or in the country of the applicant’s nationality. Third-country nationals may apply for an entry visa for receiving a residence permit before admission to the country in the application for residence permit, without having to lodge a separate application.

 

If the decision of the regional directorate is in favour of the application for residence permit, it shall constitute approval for the issue of an entry visa for receiving a residence permit, of which the competent consulate officer shall be notified. The entry visa for receiving a residence permit shall be issued by the competent consulate officer based on the regional directorate’s decision.

 

Moreover, please note that D visas for entitlement to receive a residence permit issued to third-country nationals are single-entry visas authorising a stay of not more than 30 days.

 

Apart from the submission of applications for issuing a residence permit at Hungarian diplomatic mission as a general rule, Hungarian law also provides for the possibility of submitting such applications in Hungary as well. Third-country nationals residing in the territory of Hungary may submit an application for residence permit at the regional directorate responsible for the place where the place of accommodation of the third-country national is located if there are special circumstances to justify the submission of the application in Hungary, or if legally residing in the territory of Hungary as a national of the States listed in Annex II of Regulation (EU) 2018/1806 of the European Parliament and of the Council, or together with such third-country national in the capacity of a family member. The special circumstance referred to above shall, in particular, cover any event related to medical treatment, family reunification or occupational activity that has occurred for reasons beyond the third-country national’s control, and that prevents the submission of the application at a place in accordance with the general provisions set out by law. An application for issuing a residence permit on the grounds of special circumstances may be submitted only in person to the authority of first instance competent for the place of accommodation.

 

A third-country national of a visa-free country, legally residing in Hungary without a visa can submit an application for a residence permit electronically upon registration on the electronic platform of the immigration authority for procedure initiation.


The application for extension of the residence permit shall be submitted 30 days before it expires at the latest electronically upon registration on the electronic platform of the immigration authority for procedure initiation.

Please note that an application submitted electronically is deemed to have been received by the authority if the administrative service fee has been paid. Furthermore, it is necessary to appear before the competent regional directorate within 15 days of the confirmation of receipt in order to verify your identity, to take your biometric data and a specimen signature, and to have your documents recognised.

 

Extension of the residence permit may be granted only if the conditions set out in the law are met and the residence of the third-country national has exceeded 90 days within any 180 days prior to the submission of the application for a residence permit.

 

1.    The administrative service fee charged for the procedure for issuing a residence permit is EUR 110, which is to be paid at the diplomatic or consular mission in EUR or in other convertible currency, or in exceptional cases, in the legal tender of the state in which the application is submitted.

2.    The administrative service fee charged for the procedure for the extension of a residence permit is HUF 23,000, if the application is lodged electronically via NDGAP’s electronic procedure initiation platform (Enter Hungary).

3.    The administrative service fee charged for the procedure for issuing a residence permit for a third country national holding the citizenship of a visa-free country, legally residing in Hungary is HUF 24,000 if the application is lodged electronically via NDGAP’s electronic procedure initiation platform (Enter Hungary).

4.    The administrative service fee charged for the submission of an application for the procedure for issuing a residence permit on the grounds of special circumstances, accompanied by a petition for equitable consideration is HUF 39,000 if submitted in person within the territory of Hungary.

 

The administrative service fee is to be paid by way of an electronic payment instrument (bank card). In case of submission of an application for the procedure for issuing a residence permit on the grounds of special circumstances accompanied by a petition for equitable consideration submitted in person within the territory of Hungary the administrative service fee is to be paid by way of an electronic payment instrument (bank card) or in the form of a bank deposit (using the cheque supplied by the regional directorate).

The regional directorate shall rule on the application for residence permit for other purposes within 21 days. The competent immigration authority shall deliver the residence permit document to the applicant by way of post. The applicant may collect the residence permit document at the competent immigration authority in person if able to evidence that he/she is not in a position to receive the residence permit document at the mailing address given, however, he/she is required to prove such circumstances.

 

In case of a refusal, the decision may be appealed within 8 days after the decision was delivered and the appeal is to be submitted before the authority of first instance or the diplomatic or consular mission where the application was submitted. If the appeal is submitted after the deadline or if made by a person other than the persons entitled to submit an appeal against the decision in the applicant’s case, and if the applicant introduces any new evidence in the appeal, of which he/she was aware before the decision was adopted, or if the appeal is lodged without showing cause, the authority of first instance shall dismiss the appeal without any examination as to merits.

 

The administrative service fee charged for an appeal submitted at a diplomatic or consular mission against a first instance decision in procedures is EUR 160, which is to be paid in Euros or in other convertible currency, or in exceptional cases, in the legal tender of the state in which the application for an appeal is submitted. In case of submissions within the territory of Hungary the administrative service fee charged for an appeal against a first instance decision is HUF 47,000, which is to be paid by way of an electronic payment instrument (bank card) or in the form of a bank deposit (using the cheque supplied by the regional directorate). When paying by using a yellow cheque, the client’s name and date of birth, and the case type i.e. “Residence Permit Appeal” are to be indicated in the “comment” box.

DOCUMENTS VERIFYING THE PURPOSE OF RESIDENCE

In the case of residence for other purposes the client is to submit the document evidencing the purpose of residence.

 

DOCUMENTS IN PROOF OF MEANS OF SUBSISTENCE IN HUNGARY

A third-country national is considered to have sufficient resources to cover his/her subsistence for residence exceeding ninety days within a one hundred and eighty day period if his/her lawful income or assets or his/her family member’s income or assets is sufficient to cover their living expenses, including accommodation, return travel, and if necessary, healthcare.

 

The requirement of subsistence may, in particular, be verified by:

·      a certificate on the payment of scholarship grant;

a certificate on payment of pension or annuity;

·      funds held on bank accounts;

·      a certificate issued by the employer and/or tax authority evidencing regular income received from abroad;

·      if the third-country national’s residence in Hungary is financed by his/her family member, family relationship is to be verified, together with documentary evidence in proof of such family member’s ability to provide support;

·      other documents.

 

DOCUMENTS PROVING THE EXISTENCE OF HUNGARIAN ACCOMMODATION

The place of Hungarian accommodation must be a property shown in the real estate register as a residential building or detached house, or any similar property suitable for habitation (minimum 6 square meters of living space per person) or a commercial or other accommodation deemed appropriate by law.

 

Compliance with the requirement of accommodation in Hungary may be verified by:

·      a residential lease contract in proof of the rental of a residence;

·      a document on accommodation by courtesy;

·      a document in proof of ownership of the residential property, by means of a certified copy of title deed issued within 30 days to date;

·      a valid letter of invitation with an official certificate affixed;

·      documentary evidence to verify the reservation of accommodation and payment;

·      a notarised statement made by a family member with the right of residence in Hungary as holding a long-term visa or residence permit, with immigrant or permanent resident status, holding a residence card or a permanent residence card in accordance with specific other legislation, or with refugee status, promising lodging to the applicant; or

·      a real estate sales contract and a copy of the decision of the competent Budapest or county government agency granting permission for the acquisition of a real estate property;

·      other documents.

 

 

DOCUMENTS PROVING THE EXISTENCE OF COMPREHENSIVE HEALTH INSURANCE

 

Enclosed with the application for residence permit the applicant shall provide proof of having access to comprehensive health insurance services (in particular on the basis of specific other legislation on the social security system, international agreement, or under specific agreement), or that he/she has the necessary financial resources to cover the costs of such services.

 

DOCUMENTS EVIDENCING THE CONDITIONS OF EXIT

 

The conditions of exit may be verified by:

·      a valid passport or the permits necessary for the third-country national for returning to his/her country of origin, or to the country he/she indicates;

·      and a valid ticket for departure, or sufficient funds to purchase such a ticket, or a means of transport lawfully used by the third-country national.

 

Enclosed with the application the third-country national is required to provide a statement undertaking the commitment of voluntary departure from the territory of the Member States of the European Union if the application is refused.

A minor third-country national shall provide proof that his/her parent or legal representative gave permission for his/her stay in Hungary, for the duration of the planned stay.

Parental consent shall be provided in a statement executed in a private document representing conclusive evidence or an authentic instrument, with Hungarian or English translation.

 

During the process, the immigration authority may request further documents, apart from the mandatory enclosures, for ascertaining the relevant facts of the case, and may take further procedural steps as well. The administrative time limit shall not include the length of time between the receipt of the notice for remedying deficiencies until the time of compliance.

After the application is submitted the applicant or his/her representative shall be able attach documents by way of post or electronically. In case the application has been submitted electronically, the notification for remedying deficiencies and the provision of missing documents will be carried out electronically as well.

 

VALIDITY PERIOD

The validity period for a residence permit for other purposes is maximum five years, and it may be extended by maximum five additional years at a time.

 

The period of stay fixed in the residence permit is to be determined ascertaining that the travel document must be valid for at least 3 additional months beyond the date of expiry of the residence permit.

 

ACCRUED RIGHTS AND OBLIGATIONS

·      A third-country national holding a valid residence permit has the right of entry without a visa and the right of residence in the territory of Schengen Member States not exceeding ninety days within a one hundred and eighty day period.

·      Third-country nationals shall certify the fact of registering the place of accommodation with the proof of registration received upon notification of the place of accommodation. Third-country nationals are required to retain the proof of registration and to carry it at all times. When relocating, third-country nationals shall notify the immigration authority electronically upon registration on the electronic platform of the immigration authority for procedure initiation within three days.

 

·      Third-country nationals holding a residence permit shall report the birth of a child – who is also a third-country national – in the territory of Hungary and shall simultaneously supply the following information:

·        the natural identification data of the child as provided for by law;

·        particulars of the child’s travel document;

·        address of the child’s place of accommodation or home address.

 

·         Third-country nationals are obliged to report without delay to the immigration authority [the regional directorate of the National Directorate-General for Aliens Policing, any police station, or the competent Hungarian diplomatic or consular mission when staying abroad] if their travel document or residence permit is lost, stolen or destroyed. The immigration authority shall confirm receipt of such report in writing. The immigration authority shall be immediately notified in the event that a travel document, which was presumed lost and reported as such, is found subsequently.

 

Please note that the residence permit for other purposes does not constitute an entitlement to engage in gainful activity and to undertake employment.

ELIGIBILITY

 

A residence card may be issued to a family member who is a third-country national accompanying an EEA national or joining an EEA national.

 

The competent immigration authority may grant the right of residence to persons on the grounds of family reunification, who had been dependents or members of the household of an EEA national who meets the conditions of residence exceeding ninety days within a one hundred and eighty day period in the country from which they are arriving, or who require the personal care of an EEA national due to serious health reasons.

 

The family member of an EEA national shall be given the right of residence if the EEA national

 

-          plans to engage in gainful employment;

 

-        has sufficient resources for him or herself and his or her family members not to become an unreasonable burden on the social assistance system of Hungary during the period of their stay, and have comprehensive sickness insurance cover for healthcare services as prescribed in specific other legislation, or if he or she assures to have sufficient resources for such services as required by statutory provisions.

 

The spouse and dependent child of an EEA national shall be given the right of residence if the EEA national

 

- enrolled at an educational institution governed by the Act on the National Public Education System, or the Act on the National Higher Education System, for the principal purpose of pursuing a course of study, including vocational training and adult education if offering an accredited curriculum, and they have sufficient resources for themselves and their family members not to become an unreasonable burden on the social assistance system of Hungary during their entire period of residence, and have comprehensive sickness insurance cover for healthcare services as prescribed in specific other legislation, or if they assure that they have sufficient resources for themselves and their family members for such services as required by statutory provisions.

  • the spouse of an EEA national;
  • the direct descendants of an EEA national and those of the spouse of an EEA national who are under the age of 21 years or are dependents;
  • the dependent direct relatives in the ascending line of an EEA national and those of the spouse of an EEA national;
  • the partner with whom the EEA national has entered into a registered partnership before the relevant Hungarian authority or the authority of another Member State of the European Union;
  • any person whose entry and residence has been authorised by the competent immigration authority on grounds of family reunification.

If the applicant is a minor of limited capacity or if incompetent, the application shall be submitted by the applicant’s legal representative in his/her stead.

 

The application for residence card shall be submitted at the latest on the 93rd day from the time of entry or from the date of occurrence of the fact underlying the right of residence (e.g. marriage, childbirth).

 

Application for  a residence card by a family member of an EEA citizen may  be submitted in person at the client service of the competent NDGAP regional directorate as per the place of residence of the applicant within the territory of Hungary or electronically upon registration on the electronic platform of the immigration authority for procedure initiation (Enter Hungary).  For more details on electronic administration, please click here.

If the residence card is issued for a term other than five years, the family member who is a third-country national may apply for the extension of the residence card. The application for extension shall be submitted on the thirtieth day before the residence card expires upon registration on the electronic platform of the immigration authority for procedure initiation.

 

If the residence card was issued for a period of five years, and the five years have passed, the EEA national’s family member may apply for a permanent residence card, or may submit an application for another residence card.

If the applicant is a family member of an EEA national, the administrative service fee charged for the issue of a residence card is HUF 15,000, which is payable by way of electronic payment instrument (bank card).

The regional directorate shall rule the application for a residence card within 70 days. The competent immigration authority shall deliver the document to the applicant by way of post.

MANDATORY ENCLOSURES

Documents in proof of family ties:

·        birth certificate;

 

·        marriage certificate;

 

·        registrar certificate in proof of registered partnership status;

 

·        adoption document;

 

·        any other document credibly attesting the existence of family relationship.

 

Any reference made to a registrar certificate shall also be construed as a similar or equivalent document issued by a foreign authority.

 

Please note that an authentic instrument made out abroad, and any private document certified by a foreign court, administrative body, notary public or any other person vested with authority to issue authentic documents shall – unless any law pertaining to the case in question, an international agreement or the principle of reciprocity suggests otherwise – be considered affirmative proof according to Hungarian law if endorsed by the Hungarian diplomatic or consular mission in the country where it was issued. Any instrument made out in a language other than Hungarian shall be accepted only with the official Hungarian translation attached, unless otherwise prescribed by an act.

 

If the EEA national, or the family member whom he/she plans to accompany or join does not have a registration certificate or a permanent residence card, the family member is to provide proof that the EEA national

 

·        is engaged in gainful employment;

 

·        has sufficient resources for him/herself and his/her family members not to become an unreasonable burden on the social assistance system of Hungary during the period of their stay, and have comprehensive sickness insurance cover for healthcare services as prescribed in specific other legislation, or if he/she assures to have sufficient resources for such services as required by statutory provisions;

 

or

 

·        enrolled at an educational institution governed by the Act on the National Public Education System, or the Act on the National Higher Education System, for the principal purpose of following a course of study, including vocational training and adult education if offering an accredited curriculum, and they have sufficient resources for themselves and their family members not to become an unreasonable burden on the social assistance system of Hungary during their entire period of residence, and have comprehensive sickness insurance cover for healthcare services as prescribed in specific other legislation, or if they assure that they have sufficient resources for themselves and their family members for such services as required by statutory provisions.

 

If the purpose of the EEA national’s stay is to engage in gainful employment, the applicant shall supply the following proof:

 

·        the employment contract;

·        a valid contract or a statement containing the company’s corporate name as shown in the register of companies, registered number and tax number, if the EEA national is engaged in any gainful activity in the capacity of being the owner or director of a business association, cooperative society or some other legal entity formed to engage in gainful operations, or is a member of the executive, representative or supervisory board of such entity;

 

·        a valid private entrepreneur’s license or similar authorisation – issued by the competent authority of another Member State – to engage in business activities, or a private entrepreneur register number in the absence of a private entrepreneurial license;

 

·        for persons seeking employment, documents to evidence that he/she is actively seeking employment, and there is a probability of entering into gainful employment;

 

or

 

·        other reliable means.

 

If the purpose of the EEA national’s residence is the pursuit of studies, the applicant shall, in particular, supply the following proof:

 

·        a certificate of admission from an educational institution governed by the Act on the National Public Education System and the Act on the National Higher Education System;

 

·        a document to verify his/her student status;

 

or

 

·        other reliable means.

 

DOCUMENTS IN PROOF OF SUFFICIENT FINANCIAL RESOURCES

 

The applicant may verify of having sufficient means of subsistence with his/her financial assets or any regular income he/she receives in the form of

 

·        payments from the social security or social assistance system of any EEA Member State;

 

·        income from funds or benefit plans financed by payment of membership dues or other regular contributions;

 

    • a statement from a Hungarian or foreign financial institution concerning the applicant’s bank account;
    • income from maintenance or alimony supported by documentary evidence.

 

The declaration of support made by the EEA national with respect to the family member has to be enclosed with the application.

 

 

DOCUMENTS PROVING THE EXISTENCE OF HEALTH INSURANCE

 

The EEA national’s access to health insurance services (in particular on the basis of specific other legislation on the social security system, international agreement, or under specific agreement) throughout his/her stay in Hungary shall be verified by the relevant documents, or that he/she has the financial resources to cover the costs of such services.

 

REGISTRATION OF THE FIRST RESIDENCE IN HUNGARY

 

The first residence in Hungary shall be reported in the course of the proceedings for the issue of the residence card. The right of disposal with respect to the residential property must verified to the immigration authority by means of documentary evidence.

 

Residence may be verified in particular with:

 

·        a residential lease contract in proof of the rental of a residence;

 

·        a document on accommodation by courtesy;

 

·        a document in proof of ownership of the residential property, by means of a certified copy of title deed issued within 30 days to date;

 

·        other reliable means.

 

During the process, the immigration authority may request further documents, apart from the mandatory enclosures, for ascertaining the relevant facts of the case, and may take further procedural steps as well. The administrative time limit shall not include the length of time between the receipt of the notice for remedying deficiencies until the time of compliance.

 

After the application is submitted the applicant or his/her representative shall be able attach documents by way of post or electronically. Under special circumstances the applicant may submit requisite documents to the competent immigration authority in person as well, however, such circumstances must be justified. In case the application has been submitted electronically, the notification for remedying deficiencies and the provision of missing documents will be carried out electronically as well.

 

VALIDITY PERIOD

 

The validity of the residence card of a family member who is a third-country national of an EEA national is determined based upon the duration of residence of the EEA national. The residence card shall be issued for a maximum period of five years.

 

ACCRUED RIGHTS AND OBLIGATIONS

 

In case the statutory conditions are satisfied and the regional directorate issues a residence card, the Government Agency of the City of Budapest takes measures for the issue of an official address card (address card). After receiving the address card, the applicant has to report any changes in his/her residence at the district office competent on the basis of the residence or the habitual residence to be reported.

The official address card has to be kept together with the residence card, and has to be surrendered to the duly empowered authority upon request.

 

Family members, whose travel document, personal identification document, or document evidencing his/her right of residence is lost, stolen or destroyed shall report it to the immigration authority [regional directorate of the National Directorate-General for Aliens Policing , or any police station], as well as if any such document that was presumed lost and reported as such is found subsequently.

 

Unless otherwise provided by international agreement, a family member who is a third-country national whose travel document is lost, stolen or destroyed is required to obtain a replacement travel document. Such family member who is a third-country national shall be allowed to leave the country only in possession of the new travel document and certificate of the notification issued based on the report submitted to the authority as referred to above.

 

EEA nationals and their family members exercising the right of residence exceeding ninety days within a one hundred and eighty day period shall report to the regional directorate, with personal data included:

 

·        the death of a family member in their household;

 

·        change of name;

 

·        if the death or change of name occurred outside the territory of Hungary.

 

Any change concerning the right of residence due to the death of the EEA national, the dissolution or annulment of the marriage with the EEA national has to be reported by the family member to the regional directorate competent on the basis of his/her residence with proof of compliance with the conditions of further stay. The family member shall report the termination of his/her family relationship underlying his/her right of residence.

Family members may notify the regional directorate responsible for the place where the applicant’s residence is located when they no longer wish to exercise their right of residence, or if they intend to leave the territory of Hungary permanently, including the country of next habitual residence, and may turn in the document evidencing their right of residence.

 

 

Registration Certificate for EEA Nationals

ELIGIBILITY

An EEA national shall have the right of residence exceeding ninety days within a one hundred and eighty day period if he/she:

   plans to pursue gainful employment;

   has sufficient resources for him/herself and his/her family members not to become an unreasonable burden on the social assistance system of Hungary during the period of their stay, and have comprehensive sickness insurance cover for healthcare services as prescribed in specific other legislation, or if he/she assures to have sufficient resources for such services as required by statutory provisions; or

   enrolled at an educational institution governed by the Act on the National Public Education System, or the Act on the National Higher Education System, for the principal purpose of pursuing a course of study, including vocational training and adult education if offering an accredited curriculum, and they have sufficient resources for themselves and their family members not to become an unreasonable burden on the social assistance system of Hungary during their entire period of residence, and have comprehensive sickness insurance cover for healthcare services as prescribed in specific other legislation, or if they assure that they have sufficient resources for themselves and their family members for such services as required by statutory provisions.

   

EEA national: the citizens of Member States of the European Union – other than Hungarian citizens – and citizens of any State that is a party to the Agreement on the European Economic Area (citizens of the European Union, Switzerland, Norway, Iceland, and Liechtenstein).

 

NOTIFICATION OF RESIDENCE EXCEEDING

THREE MONTHS, DOCUMENT EVIDENCING

NOTIFICATION

EEA nationals shall notify their residence to the regional directorate of jurisdiction by reference to their future residence at the latest on the ninety-third day from the date of entry, and shall simultaneously disclose their personal data.

 

The client is required to appear before the competent authority in person, in order to obtain the registration certificate. The competent authority may waive the requirement of physical presence if the applicant is unable to appear due to his/her health condition.

If the applicant is a minor of limited capacity or if incompetent, the application may be submitted by the applicant’s legal representative in his/her stead. If the minor client has reached the age of six at the time the application is submitted, he/she shall be required to appear in person when the application is submitted. The responsibility for ascertaining the minor’s physical presence before the immigration authority lies with the legal representative.

In the notification of residence the client is to produce his/her valid travel document or personal identification document, and enclose documents – provided for in specific other legislation – in proof of compliance with the requirements for the right of residence.

 

In the event of verifying fulfilment of the requirements provided for by law, the competent authority shall issue a certificate of notification of residence (hereinafter referred to as “registration certificate”) immediately.

The administrative service fee charged for the issue of a registration certificate is HUF 1,000, payable by way of electronic payment instrument (bank card) or in the form of bank deposit (using the cheque supplied by the regional directorate). In respect of yellow cheques, in the “comment” box the client’s name and date of birth, and the case type “registration certificate” shall be indicated.

MANDATORY ENCLOSURES

If the purpose of the EEA national’s residence is to pursue gainful employment, the applicant shall supply the following proof:

       the employment contract;

       a valid contract or a statement containing the company’s corporate name as shown in the register of companies, registered number and tax number, if the applicant is pursuing any gainful activity in the capacity of being the owner or director of a business association, co-operative society or some other legal entity formed to engage in gainful operations, or is a member of the executive, representative or supervisory board of such entity;

       a valid private entrepreneur’s license or similar authorisation – issued by the competent authority of another Member State – to engage in business activities, or a private entrepreneur register number in the absence of a private entrepreneurial license;

       for persons seeking employment, documents to evidence that he/she is actively seeking employment, and there is a probability of entering into gainful employment; or

       other reliable means.

 

If the purpose of the applicant’s residence is the pursuit of studies, the applicant shall supply the following proof:

       a certificate of admission from an educational institution governed by the Act on Public Education and the Act on the National Higher Education System;

       a document to verify his/her student status; or

       other reliable means.

 

DOCUMENTS IN PROOF OF SUFFICIENT FINANCIAL RESOURCES

The applicant may verify of having sufficient means of subsistence with his/her financial assets or any regular income he/she receives in the form of:  

       payments from the social security or social assistance system of any EEA Member State;

       income from funds or benefit plans financed by payment of membership dues or other regular contributions;

       a statement from a Hungarian or foreign financial institution concerning the applicant’s bank account;

       income from maintenance or alimony supported by documentary evidence.

The following, in particular, may not be considered financial assets:

       articles of everyday use and household equipment and accessories;

       any property serving as the residence of the EEA national and his dependent family members;

       the vehicle of handicapped persons; and

       any assets which are required for the EEA national’s gainful activity.

 

DOCUMENTS PROVING THE EXISTENCE OF HEALTH INSURANCE

The EEA national’s access to health insurance services (in particular on the basis of specific other legislation on the social security system, international agreement, or under specific agreement) throughout his/her stay in Hungary shall be verified by the relevant documents, or that he/she has the financial resources to cover the costs of such services.

 

REGISTRATION OF THE FIRST RESIDENCE IN HUNGARY

The applicant shall notify his/her first residence in the territory of Hungary in the context of the procedure for the issue of a registration certificate. The immigration authority shall disclose the address data of the EEA national to the register of personal data and address records for the purpose of issuing an official certificate for personal identification number and official address card. Upon receipt of notice, the Government Agency of the City of Budapest shall issue the official address card, and shall send it to the applicant by post.

 

Registration of the place of residence in Hungary:

       a residential lease contract in proof of the rental of a residence;

       a document on accommodation by courtesy;

       a document in proof of ownership of the residential property, by means of a certified copy of title deed issued within 30 days to date;

       other documentary evidence.

During the process, the immigration authority may request further documents, apart from the mandatory enclosures, for ascertaining the relevant facts of the case, and may take further procedural steps if considered necessary. The administrative time limit shall not include the length of time between the receipt of the notice for remedying deficiencies until the time of compliance.

After the application is submitted the applicant or his/her representative shall be able attach documents by way of post or electronically. Under special circumstances the applicant may submit requisite documents to the competent immigration authority in person as well, however, such circumstances must be justified.

 

VALIDITY PERIOD

The registration certificate shall be valid indefinitely, together with a valid travel document or personal identification document.

 

ACCRUED RIGHTS AND OBLIGATIONS

The client shall notify his/her first residence in the context of the procedure for the issue of the registration certificate, and shall consequently receive the address card by post, for which no further action is required. After receiving the address card, the applicant has to report any changes in his/her residence at the district office where the new residence is located.

The official address card has to be kept together with the registration certificate, and has to be surrendered to the duly empowered authority upon request.

EEA nationals, whose travel document, personal identification document, or residence card is lost, stolen or destroyed shall report it to the regional directorate of jurisdiction by reference to their residence, as well as if any such document that was presumed lost and reported as such is found subsequently.

The regional directorate shall make out a certificate to the EEA national, whose travel document, personal identification document, or document evidencing right of residence is reported lost or stolen, or destroyed, concerning the fact of reporting at no cost if any proof of citizenship is produced.

EEA nationals whose travel document is lost, stolen or destroyed are required to obtain a replacement travel document, if they do not have a valid personal identification document.

EEA nationals exercising the right of residence exceeding ninety days within a one hundred and eighty day period shall report to the competent regional directorate, with personal data included:

    the death of a family member in their household;

    any change of name;

if the death or change of name occurred outside the territory of Hungary.

EEA nationals may notify the competent authority when they no longer wish to exercise their right of residence, or if they intend to leave the territory of Hungary permanently, including the country of next habitual residence, and may turn in the document evidencing their right of residence at the regional directorate responsible for the place where their residence is located.

A document evidencing right of residence shall be invalidated in the event of the EEA national’s exit from the territory of Hungary, or if the right of residence is terminated.

At the time of notification of residence, EEA nationals are required to supply a statement as to whether they suffer from any infectious disease or contagious parasitic disease as provided for in specific other legislation and considered to constitute a threat to public health, or if they receive compulsory and regular treatment with regard to the said diseases.

 

Egyéb célú tartózkodási engedély

Egyéb célból az a harmadik országbeli állampolgár kaphat tartózkodási engedélyt, aki a Harmtv. 19-27. §-ban felsorolt tartózkodási céloktól eltérő, valamely más célból kíván Magyarország területén tartózkodni, és a magyarországi tartózkodás feltételeit egyebekben teljesíti (pl. Magyarországon nem akkreditált oktatási intézményben kíván tanulmányokat folytatni, nyelvtanulás céljából érkezik Magyarországra, stb.).

A KÉRELEM BENYÚJTÁSA ÉS AZ ELJÁRÁSSAL KAPCSOLATOS INFORMÁCIÓK

Feltétele: a kitöltött formanyomtatvány, 3 hónapnál nem régebbi arcfénykép, valamint a kötelező mellékletek benyújtása, illetve az eljárási díj megfizetése

A korlátozottan cselekvőképes vagy a cselekvőképtelen kiskorú kérelmező helyett a kérelmet a kérelmező törvényes képviselője nyújtja be.

A kérelem benyújtásakor a biometrikus adatokat tartalmazó tartózkodásra jogosító okmány kiállítása céljából arcképmás készítésére és hat éves kor feletti kérelmező esetén ujjnyomat rögzítésére kerül sor, amelyet a harmadik országbeli állampolgár tűrni köteles.

A tartózkodási engedély kiadása iránti kérelmet - törvényben foglalt kivétellel - annál a konzuli tisztviselőnél vagy tartózkodási engedély iránti kérelem átvételére felhatalmazott egyéb helyen kell benyújtani, amely a kérelmező állandó vagy szokásos tartózkodási helye, illetve állampolgársága szerinti országban működik. A tartózkodási engedély átvételére jogosító vízum kiadását a harmadik országbeli állampolgár a beutazást megelőzően - erre irányuló külön kérelem előterjesztése nélkül - tartózkodási engedély kiadása iránti kérelmében kérheti.

Ha a regionális igazgatóság a tartózkodási engedély kiadása iránti kérelemnek helyt ad, egyidejűleg a tartózkodási engedély átvételére jogosító vízum kiadását is engedélyezi, és erről értesíti a konzuli tisztviselőt. A tartózkodási engedély átvételére jogosító vízumot - a regionális igazgatóság döntése alapján - a konzuli tisztviselő adja ki.

Felhívjuk továbbá a figyelmet arra, hogy tartózkodási engedély átvételére jogosító D vízum egyszeri beutazásra és 30 nap tartózkodásra jogosítja a harmadik országbeli állampolgárt.

A tartózkodási engedély kiadása iránti kérelem főszabály szerinti helyen (magyar külképviseletek) történő előterjesztése mellett a magyar jog szabályozza a tartózkodási engedély kiadására irányuló kérelem belföldi előterjesztésének lehetőségét is. A Magyarország területén tartózkodó harmadik országbeli állampolgár tartózkodási engedély kiadása iránti kérelmét a szálláshelye szerint illetékes regionális igazgatóságon is előterjesztheti, amennyiben a belföldi kérelmezést kivételes méltánylást érdemlő körülmény indokolja, vagy az Európai Parlament és a Tanács (EU) 2018/1806 rendelet II. mellékletében szereplő állam állampolgáraként, vagy ilyen harmadik országbeli állampolgárral együtt, családtagként tartózkodik jogszerűen Magyarország területén. Kivételesen méltányolható körülmény különösen a gyógykezeléssel, a családegyesítéssel vagy a keresőtevékenységgel összefüggő olyan tény, amely a harmadik országbeli állampolgárnak nem felróható okból következett be és akadályozza a jogszabályban meghatározott feltételeknek megfelelő helyen történő kérelmezést. Kivételes méltánylást érdemlő körülményre hivatkozással tartózkodási engedély kiadása iránti kérelem kizárólag személyesen terjeszthető elő a szálláshely szerint illetékes elsőfokú hatóságnál.

 

Vzummentes ország állampolgáraként vízummentesen, jogszerűen Magyarországon tartózkodó harmadik országbeli állampolgárnak a tartózkodási engedély kiadása iránti kérelmet az idegenrendészeti ügyindítási elektronikus felületen történő regisztrálást követően elektronikus úton  van lehetősége előterjeszteni.

A tartózkodási engedély meghosszabbítása iránti kérelmet legkésőbb a tartózkodási jogosultság lejártát megelőzően 30 nappal  az idegenrendészeti ügyindítási elektronikus felületen regisztrálást követően elektronikus úton szükséges benyújtani. A kérelem benyújtásakor az érvényes úti okmányt be kell csatolni. Az elektronikus ügyintézéssel kapcsolatos részletes tájékoztatást ide kattintva tekintheti meg.

 Felhívjuk figyelmét, hogy az elektronikus úton benyújtott kérelem akkor tekinthető a hatósághoz érkezettnek, ha az igazgatási szolgáltatási díj megfizetésre került. Továbbá szükséges a befogadásról szóló visszaigazolástól számított 15 napon belül megjelenni az illetékes regionális igazgatóság előtt a személyazonosság igazolása, biometrikus adatok és aláírás minta felvételezése, valamint az okiratok elismerése céljából.

A tartózkodási engedély meghosszabbítása a törvényben meghatározott feltételek teljesítése esetén is kizárólag akkor engedélyezhető, amennyiben a tartózkodási engedély iránti kérelem benyújtását megelőzően a harmadik országbeli állampolgár tartózkodása a bármely száznyolcvan napon belül a kilencven napot meghaladta.

  1. A tartózkodási engedély kiadására irányuló eljárás igazgatási szolgáltatási díj 110 Euró, amelyet a külképviseleten elsősorban EUR-ban vagy más konvertibilis valutában, kivételesen a kérelem előterjesztésének helye szerinti állam törvényes fizetőeszközével kell megfizetni.
  2. A tartózkodási engedély meghosszabbítására irányuló kérelem eljárási díja a Főigazgatóság ügyindítási elektronikus felületén (Enter Hungary) történő előterjesztés esetén 23.000 Forint. 
  3. Vízummentes ország állampolgáraként vízummentesen tartózkodó harmadik országbeli állampolgár tartózkodási engedély kiadása iránti kérelmének igazgatási szolgáltatási díja a Főigazgatóság ügyindítási elektronikus felületén (Enter Hungary) történő előterjesztés esetén 24.000 Forint. 
  4. Kivételes méltánylást érdemlő körülményre hivatkozással, méltányossági kérelem egyidejű csatolása mellett történő tartózkodási engedély kiadása iránti kérelem belföldön történő személyes előterjesztésének igazgatási szolgáltatási dí39.000 Forint.

 

Az eljárás díját elektronikus fizetési eszköz (bankkártya) útján szükséges megfizetni. Kivételes méltánylást érdemlő körülményre hivatkozással, méltányossági kérelem egyidejű csatolása mellett történő tartózkodási engedély kiadása iránti kérelem belföldön történő személyes előterjesztése esetén banki befizetés (a regionális igazgatóság által rendelkezésre bocsátott csekk) formájában, vagy elektronikus fizetési eszköz (bankkártya) útján lehet az eljárás díját a kérelmezőnek leróni.

 A regionális igazgatóság az egyéb célú tartózkodási engedély iránti kérelmet 21 napon belül bírálja el. A kérelmező részére a tartózkodási engedély okmányt az eljáró idegenrendészeti hatóság postai úton kézbesíti. A kérelmező a tartózkodási engedély okmányt az eljáró idegenrendészeti hatóságnál személyesen átveheti, ha igazolja, hogy nincs abban a helyzetben, hogy a tartózkodási engedély okmányt a kézbesítésére megjelölt címen átvegye. azonban ezen körülményeket igazolnia kell.

 Az elutasító döntéssel szemben jogorvoslatnak van helye, mely a közléstől számított 8 napon belül nyújtható be az elsőfokú döntést hozó hatóságnál, illetve a kérelmezés helye szerinti külképviseleten. Abban az esetben, ha a fellebbezés elkésett, az nem a jogosulttól származik, valamint az ügyfél fellebbezésében olyan új tényre hivatkozik, amelyről a döntés meghozatala előtt tudomása volt, illetve a fellebbezést indoklás nélkül nyújtja be, az elsőfokú döntést hozó hatóság a fellebbezést érdemi vizsgálat nélkül elutasítja.  

A fellebbezés igazgatási szolgáltatási díja külképviseleti előterjesztés esetén  160 Euró, melyet elsősorban Euróban vagy más konvertibilis valutában, kivételesen a kérelem előterjesztésének helye szerinti állam törvényes fizetőeszközével kell megfizetni. Belföldi előterjesztés esetén a fellebbezés igazgatási szolgáltatási díja 47.000 Forint, melyet elektronikus fizetési eszköz (bankkártya) vagy banki befizetés (a regionális igazgatóság által rendelkezésre bocsátott csekk) útján kell leróni. A közlemény rovatba szükséges beírni az ügyfél nevét, születési idejét és az ügytípust - „Tartózkodási engedély jogorvoslat”.

MAGYARORSZÁGI MEGÉLHETÉST IGAZOLÓ DOKUMENTUMOK

A harmadik országbeli állampolgár a száznyolcvan napon belül kilencven napot meghaladó tartózkodáshoz szükséges anyagi fedezettel akkor rendelkezik, ha ő maga vagy részére családtagja a rendelkezésére álló jogszerűen megszerzett jövedelemből, illetve vagyonból megélhetése, lakhatása, kiutazása, valamint szükség esetén egészségügyi ellátása költségeit biztosítani tudja.

 

 

A megélhetés különösen az alábbiakkal igazolható

·      ösztöndíj folyósítására vonatkozó igazolással;

·      nyugdíj / járadék folyósításáról kiállított igazolással;

·      bankszámlán elhelyezett pénzösszeggel;

·      külföldről folyósított rendszeres jövedelemről szóló munkáltatói és/vagy adóhatósági igazolással;

·      amennyiben a harmadik országbeli állampolgár részére a családtagja biztosítja a magyarországi tartózkodás ideje alatt az anyagi fedezetet, a családtagi kapcsolat igazolása szükséges, továbbá az eltartási képesség alátámasztására is mellékelni kell iratot.

·      egyéb okirattal.

 

MAGYARORSZÁGI SZÁLLÁSHELY MEGLÉTÉT IGAZOLÓ DOKUMENTUMOK

Magyarországi szálláshelyként az ingatlan – nyilvántartásban lakóház vagy lakás megnevezéssel nyilvántartott ingatlan, más lakhatásra alkalmas ingatlan (minimum 6 m2 lakóterület/fő) vagy jogszabályban meghatározott feltételeknek megfelelő kereskedelmi vagy egyéb szálláshely fogadható el.

 

A magyarországi szálláshely megléte igazolható:

·      lakásbérleti jogviszonyt igazoló lakásbérleti szerződéssel;

·      szívességi lakáshasználatról szóló okirattal;

·      a lakás tulajdonjogát igazoló okirattal, 30 napnál nem régebbi tulajdoni lap másolattal;

·      hatósági hozzájárulással ellátott érvényes meghívólevéllel;

·      lefoglalt és kifizetett szálláshely meglétét igazoló okirattal;

·      a Magyarország területén tartózkodási vízummal vagy tartózkodási engedéllyel, bevándorolt vagy letelepedett jogállással, külön törvény szerint tartózkodási kártyával vagy állandó tartózkodási kártyával rendelkező, illetve menekültként elismert családtag közjegyzői okiratba foglalt, a kérelmező lakhatását biztosító nyilatkozatával vagy

·      ingatlan adásvételi szerződéssel és az ingatlanszerzést engedélyező illetékes fővárosi vagy megyei kormányhivatal határozatának másolatával;

·      egyéb okirattal.

 

TELJESKÖRŰ EGÉSZSÉGBIZTOSÍTÁS MEGLÉTÉT IGAZOLÓ DOKUMENTUMOK

A tartózkodási engedély iránti kérelem benyújtásakor okirattal kell igazolnia, hogy az egészségügyi ellátások teljes körére biztosítottnak minősül (így különösen a társadalombiztosításról szóló külön törvény, nemzetközi szerződés, vagy külön megállapodás alapján jogosult az egészségügyi szolgáltatások igénybevételére), vagy egészségügyi ellátásának költségeit a rendelkezésre álló anyagi fedezetből biztosítani tudja.

 

A KIUTAZÁS FELTÉTELEIT IGAZOLÓ DOKUMENTUMOK

A kiutazás feltételei igazolhatók:

·      érvényes útlevéllel vagy a harmadik országbeli állampolgár általa megjelölt országba történő beutazáshoz vagy a kiindulási országba történő visszautazáshoz szükséges engedélyekkel,

·      és érvényes menetjeggyel, illetve annak megvásárlásához szükséges anyagi eszközökkel vagy a külföldi jogszerű használatában lévő közlekedési eszközzel.

 

A harmadik országbeli állampolgár a kérelem benyújtásával egyidejűleg nyilatkozni köteles arra vonatkozóan, hogy a kérelem elutasítása esetén vállalja-e az Európai Unió tagállamainak területéről történő önkéntes távozást.

 

A kiskorú harmadik országbeli állampolgárnak igazolnia kell, hogy szülője vagy törvényes képviselője magyarországi tartózkodásához – a tervezett tartózkodás időtartamára – hozzájárult.

A szülői hozzájárulást teljes bizonyító erejű magánokiratba vagy közokiratba kell foglalni, valamint magyar vagy angol nyelvű fordítással ellátni.

 

A kötelező mellékleteken kívül az eljárás során az idegenrendészeti hatóság a tényállás tisztázása érdekében további okiratok benyújtására is felhívhatja, valamint egyéb eljárási cselekményt is foganatosíthat. A hiánypótlásra irányuló felhívástól az annak teljesítéséig terjedő idő az ügyintézési határidőbe nem számít bele.

A kérelmező vagy annak képviselője a kérelem benyújtását követően csatolt iratokat postai vagy elektronikus úton csatolhatja a kérelméhez. Amennyiben a kérelem elektronikus úton került benyújtásra a hiánypótlási felhívás és annak teljesítése is elektronikus úton történik.

 

ÉRVÉNYESSÉGI IDEJE

Az egyéb célú tartózkodási engedély érvényességi ideje legfeljebb öt év, amely alkalmanként legfeljebb öt évvel meghosszabbítható.

 A tartózkodási engedélyben foglalt tartózkodás időtartamát úgy kell meghatározni, hogy az úti okmánynak a tartózkodás engedélyezett időtartamán felül még legalább 3 hónapig érvényesnek kell lennie.

 

KAPCSOLÓDÓ jogok és kötelezettségek

·      A schengeni tagállamok területén az érvényes tartózkodási engedély birtokában száznyolcvan napon belül kilencven napot meg nem haladó időtartamú vízummentes beutazásra és tartózkodásra jogosult.

·      A harmadik országbeli állampolgár a szálláshely bejelentésének tényét a szálláshely igazolással igazolja. A szálláshely bejelentésről kapott igazolást a harmadik országbeli állampolgárnak magánál kell tartania és azt meg kell őriznie. A harmadik országbeli állampolgár a szálláshelyének megváltozását köteles három napon belül bejelenteni az idegenrendészeti ügyindítási elektronikus felületen történő regisztrálást követően elektronikus úton.

·      Ha a tartózkodási engedéllyel rendelkező harmadik országbeli állampolgárnak Magyarország területén harmadik országbeli állampolgár gyermeke születik, ennek tényét köteles a következő adatok közlésével bejelenteni:

·      a gyermek törvényben meghatározott természetes személyazonosító adatai;

·      a gyermek úti okmányának azonosító adatai;

·      a gyermek szálláshelyének címe vagy lakcíme.

·      A harmadik országbeli állampolgár köteles úti okmányának, valamint tartózkodásra jogosító engedélyének elvesztését, eltulajdonítását vagy megsemmisülését az idegenrendészeti hatóságnál (az Országos Idegenrendészeti Főigazgatóság regionális igazgatóságánál,  rendőrkapitányságon vagy külföldi tartózkodás esetén az illetékes külképviseleten) haladéktalanul bejelenteni. A bejelentésről az idegenrendészeti hatóság igazolást állít ki. Az elveszettnek hitt és az erről szóló bejelentés után megtalált úti okmányról az idegenrendészeti hatóságot haladéktalanul értesíteni kell.

·      Felhívjuk a figyelmét, hogy az egyéb célú tartózkodási engedély jövedelemszerző tevékenység folytatására és munkavállalásra nem jogosít.

Please be informed that you may request the issuance of your residence permit under transitional provisions of the new aliens policing legislation on the admission and residence of third-country nationals for one of the legal titles as per the new aliens policing legislation if you are a holder of a valid residence permit under the previous legislation. Please note that only applications for the issuance of a residence permit may be submitted in person or via the Enter Hungary system. The extension of a residence permit is not allowed under the transitional rules. An application for the issuance of a residence permit may be submitted 45 days before the date of expiry of the residence permit the soonest. In case of residence permits expiring between 1 March 2024 and 1 April 2024, an application for the issuance of a residence permit is to be submitted the latest on the last day within the validity period of the residence permit concerned.
