In accordance with Government Decree 233/2020 (May 26) on diverging measures relating to

the conditions for lodging an APPLICATION FOR ASYLUM

 

 

Personal scope of logding an application:

Present procedural rules apply to foreign nationals wishing to enter Hungary with the purpose of lodging an application for asylum.

 

Temporal scope of lodging an application:

Present procedure shall apply to declarations of intent submitted after May 26, 2020.

 

Way of lodging an application

Application shall be primarily submitted in person and in the form of a declaration of intent (hereinafter: declaration). The declaration addressed to the asylum authority can be submitted at a diplomatic representation of Hungary located outside of the Schengen Area (hereinafter: embassy) with the content defined and published by the asylum authority.

 

Procedure of lodging an application

  1. The declaration of intent is assessed by the asylum authority during which the authority may interview the foreign national present in person at the Embassy in the form of remote hearing.
  2. In case as a result of the assessment concluded by the authority the foreigner becomes eligible for a travel document entitling its holder to single entry to Hungary (hereinafter: travel document), the asylum authority informs the Embassy about this fact within 60 days in order to issue the travel document.

Based on the information provided by the asylum authority, the embassy of Hungary issues a travel document valid for 30 days, provided that the foreigner does not hold a permit for entry into Hungary.

3. In case the asylum authority does not support the issuance of travel document based on the assessment concluded, the authority informs the foreign national about this via the embassy.

4. During the procedure the asylum authority contacts the foreign national exclusively via the embassies.

 

Further rules for foreigners holding a travel document

  1. A foreign national holding a travel document shall confirm his/her intention to submit an asylum application to the border police authority immediately upon entry into the country.
  2. Border police shall bring the foreign national to the asylum authority within 24 hours at the latest.
  3. Asylum authority may issue an order to designate accommodation for the asylum seeker in a closed reception centre. Asylum authority shall determine subsequent accommodation in accordance with the general rules of the asylum procedure four weeks after the application has been lodged, provided that the conditions for ordering asylum detention are not met.

 

Specific measures

  1. Asylum application is not conditional on the submission of the declaration of intent referred to in the course of the procedure and general rules shall apply to the submission of the application in the following cases:

-          beneficiaries of subsidiary protection residing in Hungary,

-          family members of recognised refugees and beneficiaries of subsidiary protection as defined in Asylum Act who were staying in Hungary at the time of the submission of the asylum application,

-          a person subject to a coercive measure or measures restricting personal liberty, unless he/she irregularly crossed the border of Hungary.

2. A foreign national crossing the border of Hungary irregularly – if indicates the intention to submit an asylum application – is directed by the police to the Hungarian embassy in the neighbouring country where the border crossing took place.

Please be informed that due to the current situation caused by the pandemic from Monday, March 30, 2020 administration requiring personal appearance is possible ONLY in urgent and duly justified cases and only with an appointment booked.

 

Booking an appointment is possible in the following case types:

  • extension of permanent residence/immigration permit
  • change or replacement of residence documents
  • issuing/extension of certificate of temporary residence
  • receiving registration certificate document for EEA nationals requested via Enter Hungary
  • documents of third country nationals wishing to leave the territory of Hungary but being unable to do so due to the current situation caused by the pandemic
  • capturing biometric identifiers

Please only book an appointment for cases with similar importance to the ones listed above.

In case no new appointment is booked, we will not be able to receive you.

 

Please do not book an appointment for submitting missing documents. Missing documents shall be submitted via the online aliens policing system (Enter Hungary) or sent by post.

Please be advised that applications shall be submitted and reporting obligations shall be fulfilled via Enter Hungary (https://enterhungary.gov.hu/eh/).

Application types which can be submitted via Enter Hungary:

  • ·issuing and renewing residence permit (16 types)
  • ·temporary residence permit
  • ·student mobility
  • ·commencement and termination of employment
  • ·reporting cancellation of employment
  • ·change of address
  • ·short-term mobility of researchers
  • ·birth of third country national child in the territory of Hungary

Notification about the validity period of residence documents

9th of April 2020.

 

We hereby inform our Clients, that due to the epidemiological situation the validity period of the issued residence documents, permanent residence and immigration permits – except for the short-term visa and entry visa for receiving a residence permit – is automatically extended until the 45th day after the end of the emergency phase.

 

This concerns the following documents which were valid till 2400 on the 6th of April 2020. or expired on that day:

-          Permanent residence card

-          Residence card issued to third-country national family member of a Hungarian citizen

-          Permanent residence card for EEA nationals

-          Residence permit

-          Immigration permit

-          Permanent residence permit

-          Interim permanent residence permit

-          EC permanent residence permit

-          National permanent residence permit

 

This does not concern the residence documents which have already been expired

 

Please note that the the above mentioned residence documents have to be extended 30 days before their expiry date, so the application for the extension has to be submitted within 15 days after the end of the emergency phase.

We kindly request our Clients not to submit applications for the extension of the above mentioned residence documents at present.

 

Important!

 

The valid residence documents only enable the owner to the previously acquired rights, and are only automatically extended if all required conditions for the residence document are unchanged.

 

In case the required conditions for the issued residence document change (e.g. change of employer, change of position within the company, or e.g. a student would like to strart working) then it is necessary to submit an application for a new type of residence permit or to apply for the extension of the valid residence permit.

 

Please note that in case the conditions for acquiring the residence document stated by the law are no longer met it will still result in the withdrawal of the residence document.

Information for clients regarding coronavirus epidemic

We would like to kindly inform our clients that according to the decision of the Hungarian Government the borders of Hungary had been closed at 00.00 on March 17, 2020.
Having regard to the above, foreigners who have left or will leave Hungary will not be able to re-enter for the duration of the measure.

 

In order to reduce the spread of coronavirus infection the National Directorate-General for Aliens Policing makes the following recommendations to its clients:

  • We kindly ask our clients to wait outside the client areas at a sufficient distance until their turn.
  • The risk of disease and further spread of the epidemic can be reduced by avoiding personal appearance at the customer services.
  • We urge our clients, if possible, to make an appointment and in the lack of this, contact personally the customer services only in duly justified cases.
  • Please use the online system, Enter Hungary in order to submit applications and statements.
  • Completed residence permit documents will be delivered by post to a Hungarian address provided. If you are staying in Hungary, even if you requested to collect your residence permit personally, the document will still be mailed.

 

Please do not submit the following documents during the state of emergency:

·         request for official endorsement of invitation letter

·         applications for national permanent residence permit and EC permanent residence permit

·         application for issuing travel documents for persons possessing an immigration permit or permanent residence permit, or for stateless, refugee and subsidiary protected persons

 

Please submit missing documents electronically or by post.

Information for Iranian citizens on coronavirus epidemic

 

Budapest, 6 March 2020

 

Due to the situation caused by the spread of the coronavirus, we call the attention of Iranian nationals arriving to Hungary that in case it is proven that your flight have been cancelled due to the coronavirus or you have been prevented from returning to your country - also given that you are legally present on the territory of Hungary and the Schengen States - please contact Customer Service of National Directorate-General for Aliens Policing immediately to resume your stay.

We would like to ask Iranian nationals currently staying in the territory of Budapest and Pest County with valid Schengen visa (valid for 90 days of stay) or short-term visa with limited territorial validity (Hungary) expiring shortly during the current coronavirus epidemic, please visit Central Office of National Directorate-General for Aliens Policing (Budapest, Budafoki út 60.) out of business hours or Customer Service of the Regional Directorate of Budapest and Pest County during office hours in order to extend your visa or resume your legal stay.

Iranian nationals staying outside of the jurisdiction of Budapest and Pest counties should contact Customer Service of the competent regional directorate at their place of residence in Hungary in order to resume their legal stay.

Information about the new coronavirus epidemic

 

26 February 2020

This brochure is based on the data of the European Center for Disease Prevention and Control (ECDC) on 26 February 2020 and the data of the World Health Organization (WHO) on 25 February 2020. An epidemic of pneumonia with unknown origin was reported from Wuhan, China, to the WHO in December 2019. A new coronavirus has been confirmed by Chinese health authorities as cause of the diseases, which can spread from person to person. The WHO declared an international epidemic emergency due to the new coronavirus epidemic on 30 January 2020. According to the information of the ECDC, the case definition for confirmed diseases changed in Hubei Province on 12 February 2020, according to the Hubei Health Committee decision. According to the new case definition all clinically diagnosed patients must be regarded as confirmed COVID-19 without laboratory confirmation. Clinically diagnosed is a suspect case[1] who has an imaging examination for pneumonia. According to the information from the Hubei Provincial Health Committee the conditions have been changed to ensure that individuals who meet the criteria for a clinically diagnosed patient receive timely treatment and improve healing rates. Due to the revision of the case definition, the disease data reported on 13 February 2020 cannot be compared with the data of the previous period. The case classification changed again in Hubei Province on 20 February 2020, a confirmed case is a laboratory confirmed case again.

According to ECDC’s daily report data of 26 February 2020, 893 new cases of COVID-19 have been reported globally on 26 February bringing the total number to 81 027 and 65 deaths have been reported bringing the total number of deaths to 2 763. 78 095 cases (of which 346 new cases) were reported in China (besides the cases reported in Macao and Hong Kong), of which 2 716 patients (53 new cases) died. Since 31 December 2019 and as of 26 February 2020, 65 187 cases have been reported in Hubei Province. In areas outside China (including Hong Kong and Macao), a total of 2 837 confirmed cases were reported from 40 countries / territories (including cases reported in Japan from international cruise). In Italy, the number of deaths has risen to eleven. Fifteen deaths occurred in Iran, 11 in South Korea, 4 on international cruise (Japan), and 2 in Hong Kong (SAR). Deaths were reported from the Philippines, Taiwan, Japan and France. A total of 383 confirmed COVID-19 cases were reported from Europe (France, Germany, Finland, Italy, Russia, Spain, Sweden, Great Britain and Belgium, Switzerland, Croatia, Austria).



[1] In China, a disease is a suspect case if the following two clinical conditions are met: fever and / or respiratory symptoms and normal or decreased white blood cell count in the early stages of the disease or decreased lymphocyte count regardless of whether information on a known epidemiological link is available.
