Acquisition/reacquisition of Hungarian Citizenship

We hereby inform you that citizenship, native registry and change of name matters previously assigned to the Office of Immigration and Nationality are transferred to the Prime Minister’s Office and to the Government Office of the Capital City Budapest as of 1 January 2017. The acquisition of Hungarian citizenship by declaration – definitions

One of the legal grounds for acquisition of Hungarian citizenship is a written declaration addressed to the president of the republic, submitted on a designated application form.

The scope of eligible persons is determined by points a)-c) of subsection (1), Section 5/A of Act LV of 1993 on Hungarian citizenship.

Eligible persons

The cases in which the Hungarian citizenship may be acquired or reacquired by declaration:

• Any person who lost his citizenship by any of the below circumstances may reacquire his/her Hungarian citizenship regardless of his/her place of residence:

1) he/she was deprived of his/her Hungarian citizenship by virtue of Act X of 1947 and Act XXVI of 1948, of Act LX of 1948 on Hungarian Citizenship or of Act V of 1957 on Citizenship;

2) if his/her Hungarian citizenship ceased between 15 September 1947 and 2 May 1990 by expatriation;

3) he/she was a person obligatory resettled in Germany;

• Any person who was born to a Hungarian citizen mother and a foreign citizen father before 1 October 1957 and did not become Hungarian citizen by birth by virtue of the legal rules in effect at the time, may acquire Hungarian citizenship regardless of his/her place of residence

• Any stateless person may acquire Hungarian citizenship by declaration if he/she was born in Hungary to foreign citizen parents living in Hungary, and he/she has not acquired the foreign citizenship of his parents by birth, provided that at his/her date of birth the parents had a residence in Hungary. The declaration may be submitted by the applicant before reaching the age of 19, provided that he/she has been residing in Hungary for at least five consecutive years prior to the submission of the declaration.
If the above conditions are not met and the applicant is stateless, he/she may acquire Hungarian citizenship in a preferential naturalisation procedure.

Submission of the declaration

Where and how the declaration shall be submitted?

The declaration shall be submitted in person on the designated application form to:

• the district (capital district) office of the capital and county government offices,
• to the integrated customer service ("e-government"),
• to the Hungarian consular official, or
• to the regional directorates of the Office of Immigration and Nationality.

Required attachments

Which documents shall be attached to the application?

• birth certificate,

• proof of marital status;

Birth certificates and proof of marital status shall be attached to the application in original. Documents issued in a foreign language shall be accompanied by a certified Hungarian translation and - unless otherwise provided by the terms of an international agreement – shall be furnished with diplomatic or consular legalisation. Certified Hungarian translations are prepared by the National Office for Translation and Attestation in Hungary.

• in case of expatriated persons, the original certificate of expatriation, if possible;

• at the call of the Office of Immigration and Nationality, the stateless person shall attach the document in proof or presumptive proof of statelessness;

• in case of persons born to a Hungarian citizen mother and a foreign citizen father before 1 October 1957, the parents' marriage certificate and the mother's birth certificate.

The application shall be accompanied by the application form required for the national registration of registry events that had occurred abroad, and if the applicant wishes to establish a residence in Hungary the application form required for the entry into the register of personal data and addresses shall also be attached.

The applicant may choose whether to appear in the register as a Hungarian citizen living abroad or to declare a place of residence in Hungary. In the first case, there is no separate form designated for this purpose; and the Office of Immigration and Nationality shall ensure the registration based on the foreign residence indicated on the declaration application form. The applicant shall receive the citizenship certificate together with the national registry certificate, the official card certifying his/her personal identification number and the official address card (residence card), since all these procedures are conducted by the Office of Immigration and Nationality. If the applicant declares a residence in Hungary the data sheet shall be forwarded by the Office of Immigration and Nationality to the Central Office for Administrative and Electronic Public Services for registration.

The consideration of the application, available legal remedy

What is the deadline for processing an application?

The Office of Immigration and Nationality shall issue a certificate of acquisition of the citizenship within 60 days of receipt of the declaration. The applicant shall acquire Hungarian citizenship as of the date of submission of the declaration. Based on the certificate the applicant may request the issue of Hungarian documents (e.g., identity card, passport).

The deadline for processing the application shall not include the time period between the call for submission of missing documents and the fulfilment of the submission obligation, the period of suspension of the procedure, and the time period between a request to another authority or state body and the reply to this request.

The deadline may be extended for sixty days on one occasion, if appropriate.

Is there any legal remedy available in the procedure?

If the statutory requirements of the acceptance of the declaration are not met (including if the declaration is submitted not in the required form), the Office of Immigration and Nationality shall establish this fact in a decision. The review of the decision may be requested from the Metropolitan Administration and Labour Court within 30 days from the receipt thereof.

The petition of claim must be submitted to the proceeding authority (Office of Immigration and Nationality).
