ELIGIBLE PERSONS

Foreign citizens who have never been Hungarian citizens may acquire Hungarian citizenship by naturalisation.

GENERAL CONDITIONS FOR THE SUBMISSION OF THE APPLICATION FOR NATURALISATION


• The applicant has continuously lived in Hungary for a specified period of time and must have had a permanent residence (residence card) – as an immigrant, a permanent resident, a person recognised as a refugee and a person entitled to freedom of movement and stay.
• The applicant has no criminal record and is not under prosecution.
• The applicant's accommodation and subsistence are assured in Hungary.
• The applicant's naturalisation does not violate the public and national security of Hungary.
• The applicant must pass an examination in basic constitutional studies in Hungarian language.

Renunciation of foreign citizenship is not a prerequisite for the acquisition of Hungarian citizenship; however, in some countries the acquisition of citizenship of another state may result in the loss of the original citizenship.
We recommend that you consult the competent national authorities or foreign diplomatic missions of your country in order to obtain information in this regard.

CONDITIONS FOR PREFERENTIAL NATURALISATION

Those persons who are not eligible for preferential naturalisation may apply for naturalisation after having been residing in Hungary for eight consecutive years.

 

Persons who meet the following requirements may apply for preferential naturalisation after having been residing in Hungary for three consecutive years:
• he/she has been living in a valid marriage with a Hungarian citizen for at least three years, or his/her marriage has been terminated with the spouse's death,
• his/her minor child is a Hungarian citizen,
• he/she was adopted by a Hungarian citizen (and he/she reached legal age in the meantime),
• he/she was recognized as a refugee by a Hungarian authority.

• he/she is stateless.

 

Persons who meet the following requirements may apply for preferential naturalisation after having been residing in Hungary for five consecutive years:
• he/she was born in the territory of Hungary,
he/she established residence in Hungary before reaching the legal age,
In case of a minor child the requirement for periods of time set out above may be reduced if his/her application for naturalisation is submitted together with that of his/her parent or if his/her parent has already acquired Hungarian citizenship.
The application for naturalisation of a minor child adopted by a Hungarian citizen may be submitted by the adoptive parent regardless of the child's place of residence.

PLACE AND METHOD OF SUBMISSION OF THE APPLICATION

The application for naturalisation shall be submitted in person
• to the district (capital district) office of the capital and county government offices,
• to the integrated customer service of the capital and county government offices,
• to the Hungarian consular officials, or
• to the regional directorates of the Office of Immigration and Nationality

The application for change of name is included in the application form. Several statements are required on the application form for naturalisation, such as the statement about clean criminal record, or the statement about which documents the applicant requests the authority to obtain ex officio.
The application for naturalisation must include the non-professional curriculum vitae of the applicant(s) of legal age, which shall present the applicant's course of life: the applicant's family, his/her relatives living in Hungary and abroad, when and how he/she arrived in Hungary and what he/she has been doing for a living during his stay in Hungary.

REQUIRED ATTACHMENTS

Required attachments are:
• the applicant(s)' 2 passport-size photographs (one for the application for naturalisation, and one for the identity card application form),
• the original birth certificate and original documents proving family status, e.g. marriage or death certificate, final divorce decree. (The documents issued in a foreign language shall be accompanied by a certified Hungarian translation and – unless otherwise provided by the terms of an international agreement – shall be furnished with diplomatic or consular legalisation).
• Proof of accommodation and subsistence in Hungary
Documents suitable as proof of accommodation in Hungary:
- In case of own real property the certificate of ownership or a copy of the purchase contract.
- In case of a rented apartment, the lease agreement and the certificate of ownership proving the landlord's ownership right.
- In case of persons admitted by another person, the declaration of acceptance and the certificate of ownership proving the admitting person's ownership right.
Documents suitable as proof of subsistence in Hungary, amongst others:
- Certificate of income issued by the National Tax and Customs Administration (NAV) for the applicant (and his/her spouse) for the preceding three years and the employer's certificate containing the income of the last three months.
- For retired persons the photocopy of the decision on the pension assessment (issued for the current year)
- In case of a dependant person, the declaration of support and the certificate of income (as described above) of the supporting person.
• In case of children adopted by a Hungarian citizen the final decision of the Hungarian guardianship authority,
• Certificate of the examination in basic constitutional studies (citizenship examination) or the document certifying the exemption from examination. The certificate shall not be attached if the applicant declares that he/she requested the metropolitan government office to notify the authority proceeding in naturalisation matters (Office of Immigration and Nationality) about his/her passing the examination in basic constitutional studies,

The consideration of the application shall be expedited if the applicant attaches the decision regarding the immigration permit or permanent residence permit, or the decision of the asylum authority, as well as the photocopy of the permanent residence permit.

Examination in basic constitutional studies:

The applicant may enter for the exam at the metropolitan government office in person or via mail by filling in the application form.
The examination fee is the amount corresponding to fifty percent of the statutory minimum monthly wage (minimum wage) in effect.

The following persons shall be exempted from the examination:
• persons with no legal capacity or with limited legal capacity,
• a person who graduated from a Hungarian-language educational or higher educational institution and he/she attaches to the application the copy of the certificate attesting the qualification or the diploma/degree, certified by a notary public or the institution which issued the document,
• a person over 60 years of age at the time of submission of the application,
• a person who provides proof that due to a permanent and irreversible deterioration of health he/she is not capable of passing the examination and he/she attaches to the application the statement thereof issued by the health institution competent according to the nature of the disease.

CONDITIONS FOR SUBMISSION OF AN APPLICATION FOR THE CHANGE OF NAME

Simultaneously with the application for naturalisation you may request:
• to use your own or your ancestors' former Hungarian birth family name;
• to waive one or more components of your birth family name, or suffixes or components that refer to gender of your birth name or your married name;
• to use the Hungarian equivalent of your first name.
• if you use a married name, you may request that you can use the former Hungarian birth family name of your spouse or his/her ancestor, or – in case of widowed or divorced persons – the former Hungarian birth family name of your ex-spouse or his/her ancestor
- in case of married persons – he/she uses or may request in the naturalisation procedure to use the former Hungarian birth family name of your spouse or his/her ancestor
- in case of divorced persons – your ex-spouse used his/her own or his/her ancestors' former Hungarian birth family name,
- in case of widowed persons – your ex-spouse used his/her own or his/her ancestors' former Hungarian birth family name, or could have requested in the naturalisation procedure to use those.
• indication of your deceased mother's name in Hungarian, if the mother's name had been earlier indicated in an official document in Hungarian.

The change of name in the regular naturalisation procedure shall be approved by the authority proceeding in citizenship matters. The approved change of name shall take effect on the date of taking the citizenship oath or pledge of allegiance.

THE COURSE OF THE NATURALISATION PROCEDURE

The Office of Immigration and Nationality shall forward the applications for naturalisation to the Minister of Interior within three months.

The deadline shall not include the time period between the call for submission of missing documents and the fulfilment of the submission obligation, and the time period between a request for obtaining a document necessary for the procedure from another authority or state body and the reply to this request.

The president of the republic shall issue a certificate of naturalisation attesting the acquisition of Hungarian citizenship. Subsequently, the applicant must take a citizenship oath or pledge of allegiance, for which the invitation shall be sent by the mayor of the district of his/her residence. The naturalised person shall acquire the Hungarian citizenship on the date of taking the oath or pledge of allegiance.

The mayor shall notify the applicant of the place and date of the citizenship oath or pledge of allegiance within 30 days of receipt of the document.
If the oath or pledge of allegiance is not taken within one year, the naturalisation document shall cease to have effect.

If the applicant does not meet the conditions for naturalisation and his/her application is rejected, he/she may submit a new application for naturalisation.

Hungarian citizenship may be withdrawn from a person who acquired his/her Hungarian citizenship by breaching the law, in particular, by communicating false data, or concealing data or facts, and thereby misleading the authorities.

The naturalisation procedure and the change of name procedure are free of duty.
