Notification Obligation of Persons Having the Right of Free Movement and Residence

EEA nationals and their family members shall register – in accordance with the Act on Records of the Personal Data and Addresses of Citizens – their first residence in the territory of Hungary, their country of former habitual residence during the procedures for the issue of the registration certificate or residence card.

EEA nationals and their family members, whose travel document, personal identification document, or document evidencing right of residence is lost, stolen or destroyed shall report it to the competent authority, as well as if any such document that was presumed lost and reported as such is found subsequently.

The regional directorate and the Police shall make out a certificate to EEA nationals and their family members, whose travel document, personal identification document, or document evidencing right of residence is reported lost or stolen, concerning the fact of reporting at no cost if any proof of citizenship is produced.

 

When a document that was reported lost is found by its rightful holder, and the replacement travel document or document evidencing right of residence is not yet issued, the person in question shall return the temporary certificate of right of residence to the authority where it was issued. If a document that was reported lost is found by its rightful holder, and the replacement document has already been issued, the person in question shall surrender the found document to the authority where it was issued. 

 

Unless otherwise provided by international agreement, a family member who is a third-country national whose travel document is lost, stolen, destroyed or expired is required to obtain a replacement travel document. Such family member who is a third-country national shall be allowed to leave the country only in possession of the new travel document and certificate of the notification. 

 

EEA nationals and their family members exercising the right of residence exceeding ninety days within a one hundred and eighty day period shall report, with personal data included, the death of a family member in their household and the change of name, if the death and the change of name took place outside the territory of Hungary.

EEA nationals and their family members may notify the competent authority when they no longer wish to exercise their right of residence, or if they intend to leave the territory of Hungary permanently, including the country of next habitual residence, and may turn in the document evidencing their right of residence.

An EEA national who resides in Hungary as a family member, or third-country national who is a family member shall report to the competent immigration authority – within 30 day of occurrence – the death of the EEA national family member on whose right he/she resided in Hungary, or if the marriage was dissolved or annulled by the court, with the appropriate documents enclosed, or if the sponsor EEA national no longer exercises his/her right of residence.

An EEA national or his/her family member may apply for a replacement residence document in the event of any change in his/her particulars (e.g. family name, forename, citizenship) shown in the document evidencing right of residence. The application must be accompanied by the documents in proof of the change of data in the residence document.

 

The fee charged for a registration certificate is HUF 1,000, the fee for the replacement of the residence card of a third-country national family member of a Hungarian citizen is HUF 10,000, for the issue of the residence card of third-country national family member of an EEA national is HUF 15,000 in the case of replacement, whereas the fee for the issue of permanent residence card is HUF 1,500 in the case of replacement. In addition, the administrative service fee charged for the procedure for issuing a ’Long-term Residence Card’ in case of an application for the exchange of the document is HUF 15,000. The costs of the procedure is payable by way of electronic payment instrument (bank card) or in the form of bank deposit (using the cheque supplied by the regional directorate).  In the “comment” box the client’s name and date of birth, and the case type “Registration Certificate / Residence Card / Permanent Residence Card Substitution” shall be indicated.

If the document evidencing right of residence of an EEA national or family member is lost, destroyed, stolen or damaged, he/she may request to have his/her residence document replaced.

 

The fee charged for a registration certificate is HUF 1,000, the fee for the issue of a new residence card of a third-country national family member of a Hungarian citizen is HUF 10,000, for the issue of the residence card of third-country national family member of an EEA national is HUF 15,000 in the case of substitution, whereas the fee for the issue of permanent residence card is HUF 1,500 in the case of substitution. Please be informed that you may request the issuance of your residence permit under transitional provisions of the new aliens policing legislation on the admission and residence of third-country nationals for one of the legal titles as per the new aliens policing legislation if you are a holder of a valid residence permit under the previous legislation. Please note that only applications for the issuance of a residence permit may be submitted in person or via the Enter Hungary system. The extension of a residence permit is not allowed under the transitional rules. An application for the issuance of a residence permit may be submitted 45 days before the date of expiry of the residence permit the soonest. In case of residence permits expiring between 1 March 2024 and 1 April 2024, an application for the issuance of a residence permit is to be submitted the latest on the last day within the validity period of the residence permit concerned.
